$30 Visa® Gift Card (Gift Card)

• Gift Cards cannot be returned or exchanged.
• Any expired, lost, or stolen Gift Cards will not be reissued.
• All Gift Cards will be sent to the address supplied on the donor form. Cars For Research will not be responsible for lost Gift Cards as a result of non-delivery due to incorrect or illegible addresses or other occurrences outside of our control. Title and risk of loss shall pass to the Donor upon deposit in the US Mail or third-party carrier service by Visa.
• Gift Cards are subject to restrictions as provided at Visa.com and any issues regarding your Gift Card should be directed to Visa. When contacting Visa, please reference the order number which will be sent to you from Cars For Research.

Apple iPod® (iPod)

• iPods cannot be returned or exchanged.
• Any lost, or stolen iPods will not be reissued.
• All iPods will be sent to the address supplied on the donor form. Cars For Research will not be responsible for lost iPods as a result of non-delivery due to incorrect or illegible addresses or other occurrences outside of our control. Title and risk of loss shall pass to the Donor upon deposit in the US Mail or third-party carrier service by Apple.
• Cars For Research reserves the right to discontinue offering the free engraving at any time, and furthermore, Cars For Research also reserves the right to engrave the Donor's iPod with any wording or logo that it deems fit.
• Your iPod will be shipped directly from Apple, and any issues regarding your iPod shall be directed to Apple, referencing the order number which will be sent to you from Cars For Research.

Eligibility

All accepted donations to Cars For Research are eligible to receive either a Gift Card or iPod. However, before a Gift Card and/or iPod will be issued to a Donor, Cars For Research must be in receipt of the donor's vehicle, a signed title, which must be free and clear of all liens, and the keys for the vehicle. Moreover, the title must be in sellable condition, and void of any errors or emissions which may limit or restrict the transfer of the title.

Retail Value

Total Approximate Retail Value of Apple iPod: $49
Total Approximate Retail of Visa Gift Card: $30

Please note that per IRS Regulations, the above noted amount shall be referenced on your tax-deductible receipt which you will receive from Cars For Research, and it may be required that said amount received in exchange for your donation be deducted from your aggregate tax-deductible amount.

Gift Card Terms

Visa® establishes its own policies, including specific terms and conditions, expiration or any cash back policies.

Force Majure

Cars For Research shall not be liable for any delays in the delivery of orders, due in whole or in part, directly or indirectly, to fire, acts of God, strike, shortage of raw materials, supplies or components, retooling, upgrading of technology, delays of carriers, embargo, government order or directive, or any other circumstance beyond Cars For Research's reasonable control. Donor agrees that Cars For Research shall not be liable for any direct, indirect, consequential or special damages which may result from any such delays.

Limitation of Liability

In no event shall Cars For Research be liable for any indirect, consequential or special damages and in all cases Cars For Research's liability shall not exceed the retail value of the Gift Card or iPod. BY ACCEPTING THE GIFT CARD OR IPOD, THE DONOR AGREES THAT CARS FOR RESEARCH, ITS SUBSIDIARIES, AFFILIATES, AND ALL OF THE CARS FOR RESEARCH OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY DONOR FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE GIFT CARD OR IPOD; SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS. VOID WHERE PROHIBITED.

Governing Law

This agreement shall be governed by and construed in accordance with the internal laws (and not the laws of conflicts) of the State of New York.

Inspection and Acceptance

Donor must inspect delivered Gift Card and/or iPod and report claim for damages or shortages in writing and in accordance with the applicable policy of Visa or Apple. For further information, please see Apple.com and/or Visa.com. Failure to report any damage or shortage within the applicable time allowance, shall be deemed irrevocably accepted and such claims shall be deemed waived.

Miscellaneous

If any provision in these Terms & Conditions is found to be invalid or unenforceable in any respect, the validity and enforceability of the remaining provisions shall not be affected. All clerical errors are subject to correction, and these Terms & Conditions are subject to change, without notice, and shall become immediately effective upon adoption by Cars For Research. The failure of Cars For Research to enforce at any time any of the provisions of these Terms & Conditions shall not be construed to be a waiver of such provisions nor the right of Cars For Research to enforce such provisions in the future. Any disputes arising under these Terms & Conditions shall be resolved, if not sooner settled, by a state or federal court of competent jurisdiction located in New York, New York, U.S.A., and the Donor hereby irrevocably submits to the exclusive jurisdiction of such courts.
